Privacy Policy

This Privacy Policy explains how YesterSay Games (“YesterSay,” “we,” “us,” or “our”) collects, uses, and protects information when you visit our website, purchase our products, or otherwise use our Services. This Policy should be read alongside our Terms of Use.

1. The Information we collect

Information you give us directly:

  • Name, email address, and mailing address when you place an order, sign up for our newsletter, or submit a contact form.
  • Payment information when you make a purchase, processed securely through our payment provider (we do not store full payment card details ourselves).
  • Any message content you submit through our contact or inquiry forms.

Information collected automatically:

  • Standard technical information such as IP address, browser type, device type, and pages visited, collected through our hosting provider and analytics tools for site performance and security purposes.

Information related to gameplay:

  • YesterSay cards use scan-and-record technology powered by our partner, Spokenote®. When you scan a card and record a video, that video is captured and stored through Spokenote®’s platform, governed by Spokenote®’s own privacy practices — not submitted to or stored by YesterSay directly. We do not have routine access to the content of videos you record during gameplay.

2. How We Use Information

We use the information we collect to:

  • Process and fulfill orders, including shipping and customer service communications;
  • Respond to inquiries submitted through our contact forms;
  • Send newsletter updates about new products, comics, or opportunities, if you’ve opted in;
  • Maintain, secure, and improve our website and Services;
  • Comply with legal obligations.

We do not sell your personal information.

3. Children’s Privacy

YesterSay is a family game intended to be purchased and facilitated by adults, though children may participate in gameplay under adult supervision.

  • We do not knowingly collect personal information directly from children under 13 through our website.
  • Any video content recorded during gameplay is captured and controlled by the adult(s) facilitating play, using their own device and, where applicable, their own Spokenote® account — not submitted to YesterSay directly.
  • If we become aware that a child under 13 has submitted personal information to us directly (for example, through a contact form) without parental involvement, we will take steps to delete that information.
  • Parents or guardians with questions about a child’s information should contact us using the details in Section 9 below.

4. Third-Party Services

We work with third-party service providers who process information on our behalf or in connection with your use of our Services, including:

  • Spokenote® — scan-and-record video technology used during gameplay, governed by Spokenote®’s own privacy policy.
  • Payment processors — to securely process purchases.
  • Email/newsletter provider — to send opt-in communications you’ve signed up for.
  • Hosting and analytics providers — to operate and secure our website.

These third parties have their own privacy practices, and we encourage you to review them. We are not responsible for the privacy practices of independent third-party services.

5. Cookies

Our website may use cookies and similar technologies to remember preferences, understand site usage, and support essential site functionality. You can control cookie behavior through your browser settings; disabling cookies may affect some site features.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including order history for accounting and legal purposes, and newsletter subscriber information until you unsubscribe. We do not control retention of video content stored via Spokenote®’s platform.

7. Data Security

We take reasonable measures to protect personal information from unauthorized access, use, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Your Choices

Information you give us directly:

  • Newsletter: You may unsubscribe at any time using the link in any email we send.
  • Access/correction: You may contact us to request access to, correction of, or deletion of personal information we hold about you, subject to legal and legitimate business limitations.
  • Do Not Track: Our website does not currently respond to browser “Do Not Track” signals.

9. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the “Last Updated” date above. Continued use of the Services after changes take effect constitutes acceptance of the revised Policy.
